These Terms of Service (“Terms”) govern your access to and use of the UTAU.PL website (the “Service”) and all downloads available through the Service, including but not limited to Voicebanks, 3D models, and other files.

By accessing or using the Service or downloading any content from it, you agree to be bound by these Terms. If you do not agree to these Terms, or do not understand the agreement, you may not access or use the Service or download any content.

Summary

  • You must read and agree to these Terms before downloading anything from UTAU.pl.
  • Do not use any content for any commercial purpose without explicit permission.
  • Do not use any content to impersonate or attempt to impersonate a voice provider, author, or any other individual.
  • Do not use content in any unlawful, harmful way, or in a way that infringes on others’ rights.

1. Acceptance of Terms

By using the Service, you affirm that you are of legal age to enter into these Terms or have obtained parental or guardian consent. You agree to comply with all applicable laws and regulations regarding your use of the Service and downloads.

2. Modification of Terms

  • We reserve the right to modify these Terms at any time.
  • The revised Terms of Service will become effective no less than 7 days after they are published.
  • Your continued use of the Service after the effective date of the modified Terms of Service constitutes your acceptance of the revised terms.
  • If you do not agree to the modified Terms of Service, you must stop using the Service before the effective date of the changes.

3. Prohibited Uses of Downloads

This section outlines prohibited uses of content downloaded from the Service, with a particular focus on Voicebanks and other materials enabling synthetic voice or performance. These restrictions are in place to protect the rights, reputation, and well-being of voice providers, authors, and other individuals.

You may not:

  • Impersonation: Create audio, video, or any other content that falsely represents you as the original voice provider, author, or any other individual, without their explicit written consent. This includes using the downloaded Voicebank in a manner that could reasonably mislead others into believing the content was created or endorsed by the voice provider or author.
  • Cause Harm: Create content that is harmful, defamatory, libelous, harassing, discriminatory, or promotes violence or illegal activities. This includes, but is not limited to, using a Voicebank to generate speech or singing that is offensive, spreads misinformation, or damages the reputation of the voice provider, author, or any other person.
  • Infringe Rights: Create content that infringes upon the intellectual property rights, privacy rights, or any other legal or moral rights of the voice provider, author, or any third party.
  • Sensitive or Explicit Media: Use the downloaded content, in particular the Voicebanks and associated mascots, in media that is sensitive (religious, political) or explicit (suggestive, smut, sexual) in character is strictly prohibited.

4. Download Usage Rights and Restrictions

Subject to these Terms, you are granted a limited, non-exclusive, non-transferable, revocable license to download and use the content available on the Service for non-commercial purposes only.

When using any downloaded content, you must provide appropriate attribution to the original creator or UTAU.PL as specified on the download page or within the download files.

You may not:

  • Use the downloaded content for any commercial purpose without explicit permission.
  • Redistribute, sell, sublicense, or otherwise make the downloaded content available to third parties, in part or in whole, except as specifically permitted by the terms associated with individual downloads.
  • Claim ownership of the downloaded content.
  • Remove any copyright, trademark, or other proprietary rights notices from the downloaded content.
  • Use the downloaded content in any way that is unlawful, harmful, or infringes on the rights of others.
  • Use the Service in any way that violates any applicable national, regional, or international law or regulation.

You must:

  • When using downloaded content, you must provide appropriate attribution to the original creator or UTAU.PL as specified on the download page or within the download files.
  • When describing or presenting media produced using downloaded content (such as audio or video using a Voicebank), you must include the name of the specific Voicebank or downloaded content used.

Specific downloads may have additional or different usage terms specified on their respective download pages. In case of conflict, the specific download terms shall prevail over this general section.

5. Intellectual Property

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), as well as all downloads available through the Service (including Voicebanks, 3D models, and other files), are owned by UTAU.PL, its licensors, or other providers and authors of such material.

6. Disclaimer of Warranties

The software and all downloads from the Service are provided “as is”, without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose and noninfringement. In no event shall the authors or copyright holders be liable for any claim, damages or other liability, whether in an action of contract, tort or otherwise, arising from, out of or in connection with the software or the use or other dealings in the software.

We do not warrant that the Service or any content or service obtained through the Service will be accurate, reliable, error-free, or uninterrupted, that defects will be corrected, or that the Service or any content or services obtained through the Service will otherwise meet your needs or expectations.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law principles.
